OFFICIAL CONTEST RULES

2017 Winter and Spring Terms and Conditions follow the Fall Contest Rules

NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. CONTEST PERIOD:

The Run to Quit contest (the “Contest”) is sponsored by the Canadian Cancer Society, Ontario Division (the “Contest Sponsor”). The Contest starts at 10:00 AM Eastern Time (“ET”) on August 15, 2017 and ends on December 3rd, 2017 at 11:59 PM ET (the “Contest Period”). In order to be eligible, an eligible entrant must submit his/her entry by the deadline specified in Rule 3 below (the “Run to Quit Entry” or “Buddy Entry”, as applicable).

2. ELIGIBILITY:

The Contest is open to residents of Canada, who: (i) are the age of majority in their applicable province or older at the time of entry; (ii) currently use and/or have used tobacco (defined as: cigarettes, cigars, cigarillos, pipes, chewing tobacco, snuff, water pipes and/or snus collectively, “Tobacco”) at least once weekly for a minimum of ten (10) months (does not need to be 10 consecutive months) out of the calendar year immediately prior to date of registration by an entrant; (iii) have used Tobacco at least one hundred (100) times in his/her life; and (iv) are NOT a current employee, representative or agent of the Contest Sponsor, Running Room Inc., McNeil Consumer Healthcare, a Division of Johnson and Johnson, any of their respective parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and/or any other entity involved in the development, production, administration, or fulfillment of the Contest (collectively, the “Run to Quit Entrants”).

The Contest is also open to residents of Canada, who: (i) are a supporter (ie. a “Buddy”)of a Run to Quit Entrant; (ii) do not use Tobacco under (ii) or (iii) above; (i) the age of majority in their applicable province or older at the time of entry; and (iv) are NOT a current employee, representative or agent of the Contest Sponsor, Running Room Inc., McNeil Consumer Healthcare a Division of Johnson and Johnson, any of their respective parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and/or any other entity involved in the development, production, administration, or fulfillment of the Contest (collectively, the “Buddy Entrants”).

IMPORTANT NOTE: Except for Buddy Entrants and Buddy Prize, in order to be eligible to win the Run to Quit Prize, a Run to Quit Entrant will be required to provide Tobacco-Free Status Proof.

3. HOW TO ENTER:

NO PURCHASE NECESSARY. By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Official Contest Rules (the “Rules”). There are three (3) ways a Run to Quit Entrant may enter the Contest:

  • 1. Online Virtual Training Program: To enter via the Online Training Program, visit runtoquit.com (the “Website”) and follow the on-screen instructions to: i) submit all required personal information; and (ii) purchase the Virtual Training Program (“Online Entry”), which is a Self-directed training to help you quit smoking and learn to run / walk up to 5 km (approximate purchase price is $49.99 CAD + taxes).
  • 2. Commit to Quit Program/Do-it-yourself stream: To enter via the Commit to Quit Program, visit the Website and follow the on-screen instructions to submit all required personal information (a “Commit to Quit Entry”). (There is no purchase or payment required to enter via this method of entry.)
  • 3. In-Person Program: To enter via the In-Person Program, visit the Website or visit any participating Running Room in Canada (for a list of participating Running Room locations, please see Schedule A or call the Running Room at 1-800-419-2906 ext.264) and follow the instructions provided to: (i) submit all required personal information; and (ii) purchase the In-Person Program, which is intended to help you quit smoking and learn how to complete a 5 km run (approximate purchase price is $69.99 CAD + taxes) (“In-Person Entry”).

  • A Buddy Entrant may enter the In-Person Entry only and need only participate in a minimum 5 out of 10 training program nights (a “Buddy Entry”

4. REGISTRATION DEADLINES:

To qualify for the Run to Quit Prize, submit an Online Entry, Commit to Quit Entry or In-Person Entry (collectively, a “Run to Quit Entry”) by September 30th, 2017 and be tobacco-free by October 26th, 2017. You will need to provide Tobacco-Free Status Proof (Rule 8 below) for 5 consecutive weeks leading up to November 30th, 2017. To qualify for the Buddy Prize, submit an In-Person Entry by [September 30th, 2017].

LIMITS AND VERIFICATION: There is a limit of one (1) Run to Quit Entry or Buddy Entry (as applicable) per person and email address permitted, regardless of the method of entry. For greater certainty, you can only use one (1) email address to register for, or otherwise participate in, the Contest either as a Run to Quit Entry or a Buddy Entry. Any Run to Quit Entry or Buddy Entry may be rejected if (in the sole and absolute discretion of the Contest Sponsor) it is not fully completed with all required information and submitted and received in accordance with these Rules during the Contest Period prior to the applicable deadline.

All Run to Quit Entries and Run to Quit Entrants, Buddy Entries and Buddy Entrants are subject to verification at any time and for any reason. The Contest Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Run to Quit Entry or Buddy Entry or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Contest Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Contest Sponsor within the timeline specified by the Contest Sponsor may result in disqualification in the sole and absolute discretion of the Contest Sponsor. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).

5. THE PRIZE:

There is one (1) prize available to be won in relation to the Run to Quit Entries (the “Run to Quit Prize”). The Run to Quit Prize consists of $1000 CAD (payable in the form of a cheque). The Run to Quit Prize must be accepted as awarded.

There is one (1) prize available to be won in relation to the Buddy Entries (the “Buddy Prize”). The Buddy Prize consist of: (i) ) a $500 Visa gift card. The Buddy Prize must be accepted as awarded.

6. WINNER SELECTION

PRIZES

On December 5th, 2017 at 1pm ET a random draw for the Run to Quit Prize and the Buddy Prize will take place in Toronto, Ontario from among all eligible Run to Quit Entries and Buddy Entries, as applicable, received for the fall stream in accordance with these Rules.  The first entrant drawn from the Run to Quit Entries will be deemed the potential Run to Quit Prize winner. The odds of winning a Run to Quit Prize will depend on the number of eligible Run to Quit Entries received in accordance with these Rules.

7. POTENTIAL PRIZE WINNER NOTIFICATION, VERIFICATION AND CONFIRMATION:

NOTIFICATION

The Contest Sponsor or its designated representative will make a maximum of six (6) attempts to contact the potential Run to Quit Prize winner and each Buddy Prize winner by telephone and email (using the information provided at the time of entry) within three (3) business days of the applicable draw date, or 72 hours after first attempt at contact has been made (whichever occurs later). If the potential Run to Quit Prize winner cannot be contacted within the time frames stipulated above, or there is a return of any notification as undeliverable; then the potential Run to Quit Prize winner will be disqualified (and, if disqualified, will forfeit all rights to the Run to Quit Prize) and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate potential Run to Quit Prize winner from among the remaining applicable eligible Run to Quit Entries (in which case the foregoing provisions of this section shall apply to such new potential Run to Quit Prize winner). If any potential Buddy Prize winner(s) cannot be contacted within the time frames stipulated above, or there is a return of any notification as undeliverable; then the potential Buddy Prize winner(s) will be disqualified (and, if disqualified, will forfeit all rights to the applicable Buddy Prize) and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate potential Buddy Prize winner(s) from among the remaining applicable eligible Buddy Entries (in which case the foregoing provisions of this section shall apply to such new potential Buddy Prize winner(s)).

VERIFICATION

Each potential Run to Quit Prize winner and Buddy Prize winners will be required, upon request, to provide proof of identification and eligibility (in a form acceptable to the Contest Sponsor – including, without limitation, government issued photo identification) that he/she is the entrant that submitted the applicable selected Run to Quit Entry or Buddy Entry, as applicable.

    The potential Run to Quit Prize winner will also be required to provide the following proof:
  • Tobacco-Free Status: The Run to Quit Prize winner will be required to provide proof of being tobacco-free 5 consecutive weeks prior to the date of the draw (the “Tobacco-Free Status Proof”). The Tobacco-Free Status Proof may take the form of a urine test to be administered at a mutually convenient location within 7 days following notification of being a potential prize winner. In the event that the potential Run to Quit Prize winner has used a sacred/traditional (non-commercial) tobacco product during the Contest Period, or at any time before the mandatory urine test, then he/she must declare such use to the Contest Sponsor prior to the urine test. The potential Run to Quit Prize winner will need to remain tobacco-free until after testing is completed, and while testing results are evaluated, which can take up to three (3) weeks. Failure to provide Tobacco-Free Status Proof (as determined by Contest Sponsor in its sole and absolute discretion) (i.e. fails his/her urine test) will result in disqualification in the sole and absolute discretion of the Contest Sponsor (and, if disqualified, will forfeit all rights to the Run to Quit Prize) and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate potential Run to Quit Prize winner from among the remaining applicable eligible Run to Quit Entries (in which case the foregoing provisions of this section shall apply to such new potential Run to Quit Prize winner).
  • Buddy Support: The Run to Quit Buddy Prize Winner will need to provide confirmation from the in store training coach that they attended a minimum of 5 out of the 10 training sessions.

CONFIRMATION

    Before being declared a confirmed prize winner, each potential Run to Quit Prize winner and potential Buddy Prize winner will be required to:
  • (a) correctly answer a mathematical skill-testing question without mechanical or other aid to be administered by telephone at a mutually convenient time; and
  • (b) sign and return within five (5) business days of notification, the Contest Sponsor’s declaration and release form, which (among other things):
    • (i) confirms compliance with these Rules;
    • (ii) acknowledges acceptance of the applicable Run to Quit Prize or Buddy Prize as awarded;
    • (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the applicable Run to Quit Prize or Buddy Prize, as applicable, or any portion thereof;
    • (iv) agrees to have the applicable Run to Quit Prize or Buddy Prize presented to him/her at a prize presentation event at a location, place and time to be selected by the Contest Sponsor in consultation with him/her; and
    • (v) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph (including photographs taken at the applicable prize presentation event, if applicable) or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Contest Sponsor in any manner whatsoever, including print, broadcast or the internet. In addition, each confirmed Run to Quit Prize winner and Buddy Prize winner may choose to participate in optional media interviews.

      If a selected entrant:
    • (a) fails to correctly answer the skill-testing question;
    • (b) fails to return the executed declaration and release form within the specified time; or
    • (c) cannot accept the applicable Run to Quit Prize or Buddy Prize for any reason;
      then such potential Run to Quit Prize winner or Buddy Prize winner will be disqualified (and, if disqualified, will forfeit all rights to the applicable Run to Quit Prize or Buddy Prize) and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate potential Run to Quit Prize winner or Buddy Prize winner from among the remaining applicable eligible Run to Quit Entries or Buddy Entries (as applicable) (in which case the foregoing provisions of this Rule 7 shall apply to such new potential Run to Quit Prize winner or Buddy Prize winner, as applicable).

    All confirmed Run to Quit Prize winner and Buddy Prize winner are scheduled to be publicly announced on or about January 20, 2018.

8. GENERAL CONDITIONS:

All Run to Quit Entries and Buddy Entries become the property of the Contest Sponsor. This Contest is subject to all applicable federal, provincial, territorial and municipal laws. The decisions of the Contest Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.

The Contest Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Contest Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Contest Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.

The Contest Sponsor, subject only to the approval of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Contest Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. The Sponsor reserves the right, subject only to the approval of the Régie, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Run to Quit Entry or Buddy Entry (as applicable) with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Contest Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

For Quebec residents: Any litigation respecting the conduct or organization of this Contest may be submitted to the Régie des alcools, des courses et des jeux du Quebec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

The Releasees will not be liable for any failure of the Website during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer online systems, servers, access providers, computer equipment or software; for the failure of any Run to Quit Entry or Buddy Entry or other Contest-related information to be received for any reason including, but not limited to, technical problems or traffic congestion on the internet or at any website; for late, lost, misdirected, delayed, incomplete or incompatible Run to Quit Entries or Buddy Entries (all of which are void); or any combination of the above. Further, the Releasees will not be liable for any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating or downloading any material in the Contest.

All email addresses must correspond with a valid e-mail account that may be identified by reverse domain name search. Automated and/or repetitive submission of Run to Quit Entries or Buddy Entries (including, but not limited to, registrations made using any script, macro, bot or contest service) will be disqualified and transmissions from these or related email or IP addresses may be blocked. If it is discovered by the Contest Sponsor (using any evidence or other information made available to or otherwise discovered by the Contest Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest or only the first Run to Quit Entry or Buddy Entry (as applicable) may be deemed valid, subject to its compliance with these Rules (as determined by the Contest Sponsor, in its sole discretion).

If due to printing, production, online, internet, computer or other error of any kind, more prizes are claimed under this Contest than intended to be distributed or awarded according to these Rules, then, in addition to having the right to terminate the Contest immediately (subject only to the approval of the Régie), the Contest Sponsor reserves the right to rescind invalid prize claims, conduct a random draw from amongst all eligible claimants in order to award the correct number of prizes (as applicable). In no event will the Contest Sponsor be liable to award more than the number of prizes as stated in these Rules (at any prizing level).

By entering this Contest, each entrant expressly consents to the Contest Sponsor and its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Run to Quit Entry or Buddy Entry (as applicable) for the purpose of administering the Contest and in accordance with the Contest Sponsor’s privacy policy (available at: www.cancer.ca or by emailing privacy@ontario.cancer.ca or by calling 1-800-268-8874, extension 2257). This section does not limit any other consent(s) that an individual may provide the Contest Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

By participating in this Contest, each entrant agrees to release and hold harmless the Releasees from any liability for any loss or damage of any kind to the entrant or any other person in connection with this Contest or participation in any Contest-related activities, including, but not limited to, in the case of a Run to Quit Entrant, the taking of a urine test and, if confirmed as a Run to Quit Prize winner or Buddy Prize winner, the use or misuse of the applicable Run to Quit Prize or Buddy Prize (as applicable), including without limitation personal injury, death or property damage.

In the event of a dispute regarding who submitted a Run to Quit Entry or Buddy Entry, the Contest Sponsor reserves the right, in its sole and absolute discretion, to deem the Run to Quit Entry or Buddy Entry to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

9. INTELLECTUAL PROPERTY

All intellectual property used by the Contest Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Contest Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.

10. DISCREPANCY

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Website and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control. In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and the French version of these Rules, these English Rules shall prevail, govern and control.


2017 Winter and Spring Terms and Conditions

1. CONTEST PERIOD:

The Run 2 Quit contest (the “Contest”) is sponsored by the Canadian Cancer Society, Ontario Division (the “Contest Sponsor”). The Contest starts at 10:00 AM Eastern Time (“ET”) on November 14, 2016 and ends on July 31, 2017 at 11:59 PM ET (the “Contest Period”). In order to be eligible, an eligible entrant must submit his/her entry by the applicable deadline specified in Rule 3 below.

2. ELIGIBILITY:

The Contest is open to residents of Canada, who: (i) are the age of majority in their applicable province or older at the time of entry; (ii) currently use and/or have used tobacco (defined as: cigarettes, cigars, cigarillos, pipes, chewing tobacco, snuff, water pipes and/or snus collectively, “Tobacco”) at least once weekly for a minimum of ten (10) months (does not need to be 10 consecutive months) out of the calendar year immediately prior to date of registration by an entrant; (iii) have used Tobacco at least one hundred (100) times in his/her life; and (iv) are NOT a current employee, representative or agent of the Contest Sponsor, Running Room Inc., McNeil Consumer Healthcare a Division of Johnson and Johnson, any of their respective parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and/or any other entity involved in the development, production, administration, or fulfillment of the Contest (collectively, the “Contest Parties”).

IMPORTANT NOTE: In order to be eligible to win an Initial Prize, an entrant will be required to provide: (a) 5km Run/Walk Proof; and (b) Tobacco-Free Status Proof. In order to be eligible to win an Interim Prize, an entrant will only be required to provide Tobacco-Free Status Proof (and not 5 km Run/Walk Proof). In order to be eligible to win a Survey Prize, an entrant will only need to complete the survey (and not provide Tobacco-Free Status Proof or 5 km Run/Walk Proof).

3. HOW TO ENTER:

  • 1. Online Virtual Training Program: To enter via the Online Virtual Training Program, visit runtoquit.com (the “Website”) and follow the on-screen instructions (“Online Entry”) to: i) submit all required personal information; and (ii) purchase the Online Self Directed Program, which is intended to help you quit smoking and learn how to complete a 5 km run (approximate purchase price is $49.99 CAD + taxes).
  • 2. Commit to Quit Program/Do-it-yourself stream: To enter via the Commit to Quit Program, visit the Website and follow the on-screen instructions to submit all required personal information (a “Commit to Quit Entry”). (There is no purchase or payment required to enter via this method of entry.)
  • 3. In-Person Program: To enter via the In-Person Program, visit the Website or visit any participating Running Room in Canada (for a list of participating Running Room locations, please see Schedule A or call the Running Room at 1-800-419-2906 ext.264) and follow the instructions provided to: i) submit all required personal information; and (ii) purchase the In-Person Program, which is intended to help you quit smoking and learn how to complete a 5 km run (approximate purchase price is $69.99 CAD + taxes) (“In-Person Entry”).

  • Online Entries, In-Person Entries and Commit to Quit Entries will be referred to collectively, as “Initial Entries”.

4. REGISTRATION DEADLINES:

INITIAL ENTRIES

To qualify for the applicable Interim Prize:

  • a. Winter Draw: Submit an Online Entry or Commit to Quit Entry registration by January 23rd, 2017 and be tobacco-free by February 28th, 2017. You will need to provide Tobacco-Free Status Proof (Rule 8 below) for 5 consecutive weeks leading up to April 3, 2017.
  • b. Spring Draw: Submit an Online Entry, Commit to Quit Entry or In-Person Entry registration by May 5th, 2017 and be tobacco- free by June 9th, 2017. You will need to provide Tobacco-Free Status Proof for 5 consecutive weeks leading up to July 14th, 2017.

To qualify for the Initial Prizes, you will need be tobacco-free for a minimum of 5 consecutive weeks before August 9th, 2017 and register and complete the 5 km run/walk event before July 31, 2017.

Only one (1) Initial Entry is needed to be eligible to win both the applicable Interim Prize and Initial Prize.

Entrants may register for any of the following programs: Commit to Quit, Virtual and In-Person during the Winter or Spring Contest by using the same email address and the same program may be entered by the same entrant more than once. Winning an Interim Prize does not prevent the entrant from winning an Initial Prize.

IMPORTANT NOTE: If you visit the Website between 5:00 PM ET and 11:59 PM ET on May 5th, 2017 (the “Intervening Period”), and are having difficulty following the instructions to submit an In-Person Entry, please call Running Room at 1-800-419-2906 ext.264 and leave a voicemail message (including your name and telephone number) during the Intervening Period and a representative of the Contest Sponsor, likely from Running Room, will call you back sometime between 9:00 a.m. MT and 4:00 p.m. MT on May 8th, 2017 assist you with submitting your In-Person Entry (you are solely responsible for ensuring that you are available to receive the call and prepared to submit all required information in order to complete your In-Person Entry during the call). An eligible In-Person Entry submitted pursuant to this option (as determined by the Contest Sponsor at its sole discretion) will be deemed to have been submitted by May 5th, 2017.

OPTIONAL SURVEY ENTRY

To qualify for an Optional Survey Entry, after submitting an Initial Entry, each eligible entrant will have the opportunity to receive one (1) “Survey Entry” by submitting a completed Contest survey that includes demographic questions (the “Survey”). For greater certainty, entrants are not required to complete the Survey in order to obtain an Initial Entry. There are several ways to access the Survey, as follows:

  • If you have completed an In-Person Entry or Online Entry and have provided your express consent to receive an email that includes a link to the Survey, an email will be sent to you that includes a link to the Survey.
  • At any time subsequent to completing an Initial Entry, visit your participant program members dashboard after logging into the Running Room’s website (www.runningroom.com) and follow the on-screen instructions to locate the link to the Survey that is available on your program dashboard of the Running Room’s website.

In order to be eligible, a Survey Entry must be submitted and received by 11:59 PM ET on August 10th 2017.Collectively, Initial Entries and Survey Entries will be referred to as “Entries”.

LIMITS AND VERIFICATION: There is a limit of one (1) Initial Entry per person/email address permitted, regardless of the method of entry or the number of times that that entrant registered (eg if the entrant registered for both of the winter and spring draws, that entrant will only quality as one entry for the Initial Prizes). There is a limit of one (1) Survey Entry per person/email address permitted, regardless of the method of Initial Entry. For greater certainty, you can only use one (1) email address to register for, or otherwise participate in, the Contest. If it is discovered by the Contest Sponsor (using any evidence or other information made available to or otherwise discovered by the Contest Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Contest Sponsor. Your Entry may be rejected if (in the sole and absolute discretion of the Contest Sponsor) it is not fully completed with all required information and submitted and received in accordance with these Rules during the Contest Period prior to the applicable deadline.

All Entries and entrants are subject to verification at any time and for any reason. The Contest Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Contest Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Contest Sponsor within the timeline specified by the Contest Sponsor may result in disqualification in the sole and absolute discretion of the Contest Sponsor. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).

5. THE PRIZE:

Limit of one (1) Interim Prize and one Initial Prize per person. For greater certainty, an entrant may win one of each Interim Prize, Initial Prize and Survey Prize.

INITIAL ENTRIES

    There are:
  • - one (1) grand prize (the “Grand Prize”),
  • - three (3) secondary prizes (each, a “Secondary Prize”),
  • - 10 provincial prizes (each, a “Provincial Prize”), and
  • - two (2) interim prizes (each, an “Interim Prize”),
  • available to be won in relation to Initial Entries.

The Grand Prize consists of a 2017 Honda Civic LX Coup with an approximate retail value of $25,000 CAD (the “Grand Prize”). Grand Prize includes destination/freight charges and all applicable taxes. The following terms and conditions apply to the Grand Prize: (i) the Grand Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted at the Contest Sponsor’s sole and absolute discretion); (ii) the Contest Sponsor reserves the right to substitute the Grand Prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including without limitation, but solely at the Contest Sponsor’s sole discretion, a cash award; (iii) colour and other specifics of the Grand Prize will be at the sole discretion of the Contest Sponsor and will be subject to availability; (iv) manufacturer’s warranty applies to the Grand Prize; (v) upon notification, the confirmed Grand Prize winner will be required to personally take delivery of or pick up the Grand Prize from a dealership within Canada reasonably close to the Grand Prize winner’s place of residence in Canada as designated by Contest Sponsor, in its sole discretion, and present adequate personal identification; (vi) the Grand Prize will not be released unless and until the confirmed Grand Prize winner first shows proof of having a valid driver’s license (equivalent to a full “G” class license in Ontario) and proof of satisfactory insurance (note: in the event the declared Grand Prize winner does not have or cannot get a valid license and evidence of insurance, he/she will be permitted to transfer the Grand Prize to a family member of his/her choice who has a valid license and insurance and who must sign all appropriate releases); and (vii) the Grand Prize winner is solely responsible for all costs and expenses that are not included in the Grand Prize description above, including, but not limited to: registration and license fees, insurance, fuel costs, additional accessories and any other costs associated with the Grand Prize.

There are three (3) Secondary Prizes available to be won totally $6,000. Each Secondary Prize consists of $2,000 CAD (payable in the form of a cheque). Each Secondary Prize must be accepted as awarded.

There are ten (10) Provincial Prizes available to be won totalling $10,000. Each Provincial Prize consists of $1,000 CAD (payable in the form of a cheque). Each Provincial Prize must be accepted as awarded. Provincial Prizes will be distributed as follows: one (1) award of $1,000 in Nova Scotia; one (1) award of $1,000 in New Brunswick; one (1) award of $1,000 in Newfoundland; one (1) award of $1,000 in Prince Edward Island; one (1) award of $1,000 in Quebec; one (1) award of $1,000 in Ontario; one (1) award of $1,000 in Manitoba; one (1) award of $1,000 in Saskatchewan; one (1) award of $1,000 in Alberta and one (1) award of $1,000 in British Columbia.

There are two (2) Interim Prizes available to be won for the entire country. Each Interim prize consists of $1000 CAD (payable in the form of a cheque). Each Prize must be accepted as awarded.

Collectively, the Grand Prize, the Secondary Prizes and the Provincial Prizes will be referred to as the “Initial Prizes”. The Interim Prizes will be separately awarded from the Initial Prizes.

SURVEY ENTRIES

There is one (1) survey prize (the “Survey Prize”) available to be won in relation to Survey Entries. The Survey Prize consists of $250 CAD (payable in the form of a cheque). The Survey Prize must be accepted as awarded.

Collectively, the Interim Prizes, Initial Prizes and the Survey Prize will be referred to as the “Prizes”.

6. WINNER SELECTION

INTERIM PRIZES

On April 3rd, 2017 at 1pm EST a random draw for the Winter Interim Prize will take place in Toronto, Ontario from among all eligible Initial Entries received for the winter draw in accordance with these Rules. The first entrant drawn will be deemed the potential Winter Interim Prize winner. The odds of winning an Interim Prize will depend on the number of eligible Initial Entries received for the winter draw in accordance with these Rules.

On August 9th, 2017 at 1pm EST a random draw for the Spring Interim Prize will take place in Toronto, Ontario from among all eligible Initial Entries received for the spring draw in accordance with these Rules. The first entrant drawn will be deemed the potential Spring Interim Prize winner. The odds of winning an Interim Prize will depend on the number of eligible Initial Entries received for the spring draw in accordance with these Rules.

The winners of the Interim Prizes will also be eligible for the Initial Prizes and Survey Prize (provided a Survey is completed). An entrant who qualifies but fails to win the Interim Prize in the winter draw will not be eligible to win the Interim Prize in the spring draw. An entrant who fails to qualify in the winter draw (ie is not tobacco-free by the applicable deadline) may register again for the spring draw and qualify again for an Interim Prize.

INITIAL PRIZES

On August 9th, 2017 at 1:00 p.m. ET, a random draw for the Initial Prizes will take place in Toronto, Ontario from among all eligible Initial Entries received during the Contest Period in accordance with these Rules. The first entrant drawn will be deemed the potential Grand Prize winner and the following three (3) entrants draw will each be deemed a potential Secondary Prize winner and the following ten entrants drawn in the applicable province (as set out above) will each be deemed a potential Provincial Prize winner. The odds of winning an Initial Prize will depend on the number of eligible Initial Entries received in accordance with these Rules.

SURVEY PRIZE

On August 11, 2017 at 10:00 a.m. ET, a random draw for the Survey Prize will take place in Toronto, Ontario from among all eligible Survey Entries received in accordance with these Rules. The first entrant drawn will deemed the potential Survey Prize winner. The odds of winning the Survey Prize will depend on the number of eligible Survey Entries received in accordance with these Rules.

7. ALL PRIZES - POTENTIAL PRIZE WINNER NOTIFICATION, VERIFICATION AND CONFIRMATION:

NOTIFICATION

The Contest Sponsor or its designated representative will make a maximum of six (6) attempts to contact each potential Prize winner by telephone and email (using the information provided at the time of entry) within three (3) business days of the applicable draw date, or 72 hours after first attempt at contact has been made (whichever occurs later). If a potential Prize winner cannot be contacted within the time frames stipulated above, or there is a return of any notification as undeliverable; then such potential Prize winner will be disqualified (and, if disqualified, will forfeit all rights to the applicable Prize) and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate potential Prize winner from among the remaining applicable eligible Entries (in which case the foregoing provisions of this section shall apply to such new potential Prize winner).

VERIFICATION

    Each potential Prize winner will be required, upon request, to provide proof of identification and eligibility (in a form acceptable to the Contest Sponsor – including, without limitation, government issued photo identification) that he/she is the entrant that submitted the applicable selected Entry. Each potential Prize winner will be required to provide the following proof:
  • a) 5 km Run/Walk: Each potential Initial Prize winner will be required to provide proof of having registered for and completed a publicly organized 5 km run/walk sometime between November 14, 2014 and July 31, 2017 (the “5km Run/Walk Proof”). The form of acceptable 5km Run/Walk Proof will be determined by the Contest Sponsor in its sole and absolute discretion and may include a requirement to provide written or electronic confirmation of run registration, providing a finishing time as listed on a run/walk event website and/or a statement of registration and completion of an eligible run issued by the run organizer(s). Failure to provide such proof to the complete satisfaction of the Contest Sponsor at the time of verification will result in disqualification in the sole and absolute discretion of the Contest Sponsor (and, if disqualified, such potential Initial Prize winner will forfeit all rights to the applicable Prize) and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate potential Initial Prize winner from among the remaining applicable eligible Entries (in which case the foregoing provisions of this section shall apply to such new potential Prize winner).
  • b) Tobacco-Free Status: Each potential Initial Prize winner and Interim,Prize winner may be required to provide proof of being tobacco-free 5 consecutive weeks prior to the date of each draw with a urine test (the “Tobacco-Free Status Proof”). The Tobacco-Free Status Proof will take the form of a urine test to be administered at a mutually convenient location within 7 days following notification. In the event that a potential Initial Prize winner or potential Interim Prize winner has used a sacred/traditional (non-commercial) tobacco product during the Contest Period, or at any time before the mandatory urine test, then he/she must declare such use to the Contest Sponsor prior to the urine test. Each potential Initial Prize winner or potential Interim Prize winner will need to remain tobacco-free until after testing is completed, and while testing results are evaluated, which can take up to three (3) weeks. Failure to provide Tobacco-Free Status Proof (as determined by Contest Sponsor in its sole and absolute discretion) (i.e. fails his/her urine test) will result in disqualification in the sole and absolute discretion of the Contest Sponsor (and, if disqualified, will forfeit all rights to the applicable Prize) and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate potential Initial Prize winner or potential Interim Prize winner (as applicable) from among the remaining applicable eligible Entries (in which case the foregoing provisions of this section shall apply to such new potential Initial Prize winner or potential Interim Prize winner (as applicable)).
  • NOTE: It is strongly recommend that all entrants remain Tobacco-free until after the Initial Prize winners and Interim Prize winners ( as applicable) are formally announced, since alternate potential Initial Prize winners or Interim Prize winners (as applicable) may need to be selected in accordance with these Rules.

    (A potential winner of a Survey Prize need only to have completed the Survey.)

CONFIRMATION

    Before being declared a confirmed Prize winner, each potential Prize winner will be required to:
  • (a) correctly answer a mathematical skill-testing question without mechanical or other aid to be administered by telephone at a mutually convenient time; and
  • (b) sign and return within five (5) business days of notification, the Contest Sponsor’s declaration and release form, which (among other things):
    • (i) confirms compliance with these Rules;
    • (ii) acknowledges acceptance of the applicable Prize as awarded;
    • (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof;
    • (iv) agrees to have the applicable Prize presented to him/her at a prize presentation event at a location, place and time to be selected by the Contest Sponsor in consultation with him/her; and
    • (v) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph (including photographs taken at the applicable prize presentation event, if applicable) or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Contest Sponsor in any manner whatsoever, including print, broadcast or the internet. In addition, each confirmed Prize winner may choose to participate in optional media interviews.

      If a selected entrant:
    • (a) fails to correctly answer the skill-testing question;
    • (b) fails to return the executed declaration and release form within the specified time; or
    • (c) cannot accept the applicable Prize for any reason;
      then such potential Prize winner will be disqualified (and, if disqualified, will forfeit all rights to the applicable Prize) and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate potential Prize winner from among the remaining applicable eligible Entries (in which case the foregoing provisions of this Rule 7 shall apply to such new potential Prize winner).

    All confirmed Prize winners are scheduled to be publicly announced on or about September 15, 2017.

8. GENERAL CONDITIONS:

All Entries become the property of the Contest Sponsor. This Contest is subject to all applicable federal, provincial, territorial and municipal laws. The decisions of the Contest Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.

The Contest Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Contest Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Contest Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.

The Contest Sponsor, subject only to the approval of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Contest Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. The Sponsor reserves the right, subject only to the approval of the Régie, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Contest Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

For Quebec residents: Any litigation respecting the conduct or organization of this Contest may be submitted to the Régie des alcools, des courses et des jeux du Quebec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

The Releasees will not be liable for any failure of the Website during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer online systems, servers, access providers, computer equipment or software; for the failure of any Entry or other Contest-related information to be received for any reason including, but not limited to, technical problems or traffic congestion on the internet or at any website; for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void); or any combination of the above. Further, the Releasees will not be liable for any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating or downloading any material in the Contest.

All email addresses must correspond with a valid e-mail account that may be identified by reverse domain name search. Automated and/or repetitive submission of Entries (including, but not limited to, registrations made using any script, macro, bot or contest service) will be disqualified and transmissions from these or related email or IP addresses may be blocked. When an Entry is deemed to have been duplicated in any one of the winter draw or spring draw (as determined by the Contest Sponsor in its sole discretion), only the first Entry may be deemed valid, subject to its compliance with these Rules (as determined by the Contest Sponsor, in its sole discretion).

If due to printing, production, online, internet, computer or other error of any kind, more Prizes are claimed than intended to be distributed or awarded according to these Rules, then, in addition to having the right to terminate the Contest immediately (subject only to the approval of the Régie), the Contest Sponsor reserves the right to rescind invalid Prize claims, conduct a random draw from amongst all eligible claimants in order to award the correct number of Prizes (as applicable). In no event will the Contest Sponsor be liable to award more than the number of Prizes as stated in these Rules (at any prizing level).

By entering this Contest, each entrant expressly consents the Contest Sponsor, Running Room and their agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry for the purpose of administering the Contest and in accordance with the Contest Sponsor’s privacy policy (available at: www.cancer.ca or by emailing privacy@ontario.cancer.ca or by calling 1-800-268-8874, extension 2257) and the Running Room’s privacy policy can be found at www.runningroom.com. This section does not limit any other consent(s) that an individual may provide the Running Room or Contest Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

By participating in this Contest, each entrant agrees to release and hold harmless the Releasees from any liability for any loss or damage of any kind to the entrant or any other person in connection with this Contest or participation in any Contest-related activities, including, but not limited to, the taking of a urine test, participation in any Contest-related running activity and, if confirmed as a Prize winner, the use or misuse of the applicable Prize, including without limitation personal injury, death or property damage.

In the event of a dispute regarding who submitted an Entry, the Contest Sponsor reserves the right, in its sole and absolute discretion, to deem the Entry to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address

9. INTELLECTUAL PROPERTY

All intellectual property used by the Contest Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Contest Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.

10. DISCREPANCY

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Website and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control. In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and the French version of these Rules, these English Rules shall prevail, govern and control.

Early Registration Contest

*RUN TO QUIT EARLY REGISTRATION CONTEST IS INTENDED TO BE CONDUCTED IN CANADA ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. PARTICIPANTS MUST BE OF THE AGE OF MAJORITY IN THEIR PROVINCE OR TERRITORY OF RESIDENCE OR OLDER AT THE TIME OF ENTRY. VOID IN WHOLE OR PART WHERE PROHIBITED BY LAW. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES (THE “CONTEST RULES”).

Enter online by completing registration for a Run to Quit In Store or Virtual Training Program by 11:59 PM ET on March 15, 2017 (one entry per person). 1 grand prize (FitBit Charge HR) chosen by random draw on March 16th, 2017. Odds of winning the prize depend on the number of completed registrations.  All personal information will remain anonymous. The Canadian Cancer Society will use the entrant’s Personal Information only for identified purposes, and protect the entrant’s Personal Information in a manner that is consistent with the CCS Privacy Policy at: (http://www.cancer.ca/en/about-our-site/privacy-policy/?region=on)

There is one (1) Registration Entry per person/email address permitted, regardless of the method of entry. For greater certainty, you can only use one (1) email address to register for, or otherwise participate in, the Contest. If it is discovered by the Canadian Cancer Society (using any evidence or other information made available to or otherwise discovered by the Canadian Cancer Society) that any person has attempted to: (i) exceed any of the limits stated in these Rules; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Canadian Cancer Society. The Releasees (Canadian Cancer Society/Running Room Canada) will not be liable for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom;
